IMP - The Indian court to some extent may gulp the accusations of Sexual extravagances between the married couple. However, the courts would NEVER EVER consider any false allegation inflicted by any 498A wife on her husband that the husband is a Pedophilic / Intents to sexually exploit his own child ( Be it boy or girl ).

Kindly refer the attached landmark judgment from the Honorable Supreme Court on the above - Satish Mehra Vs Delhi Administration.

As per your mail since wife by way through her learned counsel, has dared to make straight allegation of this sort on you to stop the visitation right, then I strongly suggest you to seek the legal help not only to quash all the pending cases against you but as an add on, the wife would also be fined heavily for such Pervert mentality / Psychopathic thinking.

Besides, tell the stupid lady that prima facie if at all anyone is Gay, then from where did she got impregnated herself to get this child ? Further, if any male is homosexual then it also suggests that atleast Female kid would NEVER be harmed, so the question of canceling Child Visitation right does not arise at all.

Dear Vishal,

Welcome to the club. My wife's lawyer called me Gay in divorce court and promptly said he can not prove it. And this was not in regard to trying to get a divorce ( she opposes the divorce ) but to cancel my visitations with my 5 year old daughter.

I thought my wife's lawyer was the one with a vivid imagination. But hearing about your and other cases, I guess it just goes to show that how low one has to fall to shock others today.

The wording of Sec.377 ( unnatural sexual offences ) leaves it open to be used in a multiple ways including divorce, sec.498a and maybe even clubbed with DP 3. I guess we shall soon see opposing sides in a marital dispute calling each other Gay, Lesbian, talking about Anal sex and child molestation to score brownie points in a futile debate to impress their client and awe judges who largely come from middle class backgrounds.

Dear Vishal,

That is a very interesting hypothesis. My wife in replying to my petition for visitation with my daughter replied that I personally claim that I am Gay, that I have unnatural relations with my friend's children and that I have my daughter kissed by those children against the child's wishes. She has also included the same wordings in her complain in the CAW cell ( which incidentally launched 8 months after the DVA, divorce and custody case ). She has also filed similar complaints in the office of Commissioner of Police New Delhi.

Your hypothesis is that I can use this to have my cases quashed. Can you cite some judgments or a way by which this can be done.

I am planning to use this to show cruelty on her behalf in divorce case. But will this help me in the DVA case where she has not made any such allegation.
