Hello Fighters,
Some good news to share at last..I have been on roller coaster ride from last couple of months..
Taking larger interest of my family (parents,kids,myself) and other factors of my lovely (attitude, demands, aggression etc etc) during last 3 years of legal procedure, i have decided to give one more chance to marriage life. Me and my lovely got into settlement deed and this was represented to JMFC. By the time we presented this settlement deed my case (498A) was pending for last stage which was argument of PP and my lawyer.
Considering all witness's statement and cross examination me and my family member have been acquitted from 498A. I would not say it was win only on merit as settlement has arrived is mentioned in the judgement, however as all witnesses were examined,cross examined (including IO). so it was kind of judgement based on full procedure in the court.
Reasons in the Judgement, Prosecution failed to put a case beyond reasonable doubt Prosecution failed to give any evidence Acquitted due to benefit of doubt given to accused
At present living with lovely and a kid and so far everything is good.
P.S. I am still not sure if i have taken the right decision but i feel i did what seems to be right at this point of time. Its only hope on which i am going on ........................

Personally I would not say your decision is correct but considering the fact that you have kids, your situation is different and it might be the right decision. I feel happy that your 498a is over and I hope your wife would not opt for another false 498a (She can not file another 498a case with same allegations). I suggest you to forget all the past and give a serious try and make the future life with your wife a better one. I wish you to give this forum a positive reply.

No one can comment on what is right or wrong in ur case as each case is different..
I am sure you would have thoought thrugh every thing... once we decide we have to give it a 100% chance to make the decision work.

I have read your post and you are wrong. She can file another 498a by twisting the facts and even without any modification. You will again have to run to the court to fight or quash your case. I have came across such cases where the victim is a police officer and her wife filed two consecutive FIR after withdrawing the first one.
So be cautious. Anything can happen in India.

all accused in 498a case on us are acquitted. operative part of the judgment "it is held that the prosecution failed to establish the guilt of the accused for offences u/s 498a, 406 IPC, Sec 3, 4 of DP Act and they are deserved for acquittal on ground of benefit of doubt. In result accused are found not guilty for the offences and they are acquitted u/s. 248(1) CRPC."

the charges on the last of the accused in 498a was quashed by high court. now all are cleared of the case.
